Rental Agreement for Vehicles of Rachelly Car Rental

Vehicle Rental Agreement
Between RACHELLY S.R.L. RENT A CAR, a company organized under Dominican law with its registered office at Km. 11 in Juan Dolio, Dominican Republic (hereinafter referred to as “the Lessor”), and the natural or legal person acting as the renter (hereinafter referred to as “the Renter”), the following is agreed:
1) Vehicle Handover
The Lessor provides the Renter with the vehicle described in the contract for use. The Renter confirms that the vehicle has been received in perfect condition and in accordance with the rental terms listed on the back of the contract.
2) Payment Obligations
- The agreed daily rental price (minimum rental: 1 day / 24 hours) until the return of the vehicle to the Lessor’s location.
- All damages, defects or partial/accessory thefts that occur to the vehicle during the rental period.
- Costs incurred by the Lessor for retrieving the vehicle if it is not returned on time at the agreed location. In such cases, the vehicle will be reported to the police as stolen.
- All legal and extrajudicial costs as well as fines incurred in connection with the vehicle, the Renter, or the Lessor during the term of the contract.
- The cost of any missing fuel upon return of the vehicle, plus a surcharge on the current gas station price.
3) Prohibited Use
- Driving under the influence of alcohol or drugs.
- Participation in races or speed competitions.
- Violation of traffic regulations, especially applicable legal provisions.
- Transporting more than 4 persons or more than permitted in the contract.
- Using the vehicle for illegal activities.
- Towing other vehicles.
- Transporting more people than allowed for the vehicle type, especially for payment (e.g., ridesharing, freight).
- Overloading or improper use of the vehicle without written consent from the Lessor.
4) Authorized Drivers
The Renter agrees to drive the vehicle only personally, unless the Lessor has authorized additional drivers in writing. These additional drivers are jointly liable with the Renter for compliance with all contract provisions and waive any rights of division or exclusion.
5) Insurance Coverage
Only if the Renter purchases insurance from the Lessor will they receive additional accident protection. In the event of damage, the Renter remains liable for the full value of the damaged or stolen parts according to the selected tariff.
6) Insurance Exclusions
The insurance packages offered by the Lessor do not cover theft of individual parts or accessories, nor damages to glass or tires. If no insurance package has been purchased, the Renter is fully liable for all damages or losses caused.
7) In the Event of an Accident
- Immediate notification and involvement of the traffic authorities.
- Submission of a complete accident report to the Lessor no later than the following day, along with the police report.
- Do not settle with third parties or admit fault; fully cooperate with the Lessor and/or the insurance company during the accident investigation.
- Assume all costs for vehicle recovery (including towing fees), even if the damage exceeds the agreed deductible.
8) Final Payment
The Renter agrees to pay the full rental amount and all contractually agreed fees at the time of vehicle return. The Lessor may require advance payments and initiate legal action in case of default, including late interest and legal fees.
9) Failure to Return the Vehicle
If the vehicle is not returned on the agreed date, the Lessor reserves the right to initiate legal proceedings and claim damages. The Renter and/or additional drivers authorize the Lessor to collect due amounts via the deposited credit card or an agreed payment method. The Lessor will inform the Renter of all charged amounts.
11) Immediate Repossession of the Vehicle
The Lessor may demand the return of the vehicle at any time, for example to inspect its condition or in case of contract violations. They are entitled to take possession of the vehicle immediately and at any location without being held liable.
